5. Payments
Phood Truck may use third-party payment processors, including Stripe and, where applicable, Square. When payment information is entered into a processor's checkout or payment interface, the processor receives and handles that information under its own privacy and security practices. Tooleyo may receive transaction-related information such as your name, contact information, amount paid, product or plan purchased, payment status, transaction identifiers and limited billing information needed for accounting, support, fraud prevention and subscription management.
Tooleyo does not intentionally store full payment card numbers or card security codes when those details are processed directly by our third-party payment processors.
6. Food Truck Owners & Customer Data
Phood Truck provides tools that food truck businesses may use to receive booking requests, communicate with customers, build opted-in customer lists and manage business relationships. When a food truck owner uses Phood Truck to collect or manage information about its own customers, hosts or prospects, that food truck business is responsible for using those tools lawfully, providing required notices and obtaining required permissions or consent.
Tooleyo processes such information as needed to provide Phood Truck and as directed through use of the Services. Food truck owners should not use Phood Truck to collect sensitive information that is unnecessary for the services they provide.
7. Email, Text Messages & Marketing
If you provide your email address or phone number, we may use it for transactional communications such as account notices, booking-related messages, onboarding, service updates and support. We may also send promotional communications where permitted by law and consistent with your consent and preferences.
You may unsubscribe from promotional email using the unsubscribe link in the message. Where text messaging is offered, applicable messages will include opt-out instructions such as replying STOP. Opting out of promotional communications does not prevent necessary non-promotional messages.
Mobile opt-in information and consent will not be sold to third parties for their own marketing purposes. We may share information with providers that help us deliver messaging services as necessary to provide those communications.
8. When We Disclose Information
We may disclose personal information to service providers; to integrations you choose; in connection with an actual or proposed merger, acquisition, financing, reorganization or sale of assets; when required by law or reasonably necessary for security, fraud prevention or protection of rights; and when you direct or consent to the disclosure.
We do not sell personal information for money. Certain uses of advertising, analytics or tracking technologies may be considered a “sale,” “sharing” or targeted advertising under some U.S. state privacy laws even when no money is exchanged. Where applicable, you may have the right to opt out of those activities.
9. Public Information
Certain Phood Truck features are designed to make food truck information publicly available. Information an owner chooses to publish—such as truck name, logo, photos, menu, schedule, service area, social links, website, business description and public contact or booking information—may be visible to anyone and may be indexed by search engines or shared by users. Do not publish information through public-facing features that you do not want to be publicly accessible.
10. Cookies, Analytics & Advertising
We and our service providers may use cookies, pixels, tags and similar technologies to operate our websites and Services, remember settings, maintain security, understand traffic and usage, measure conversions and evaluate advertising and marketing campaigns. You can control many cookies through your browser settings and, where provided, through consent or privacy controls on our websites. Blocking certain technologies may affect functionality.
11. Data Retention
We retain personal information for as long as reasonably necessary to provide the Services, maintain an account or business relationship, fulfill the purposes described in this Policy, comply with legal, tax, accounting and reporting requirements, resolve disputes, enforce agreements and maintain appropriate security and fraud-prevention records. Retention periods vary based on the information, its use and applicable law. We may retain deidentified or aggregated information that no longer reasonably identifies an individual.
12. Data Security
We use reasonable administrative, technical and organizational safeguards designed to protect personal information and rely on service providers that maintain their own security programs. No internet transmission, storage system or security measure can be guaranteed to be completely secure, and we cannot guarantee absolute security.
13. Your Privacy Choices & Rights
Depending on where you live and subject to applicable law, you may have rights regarding your personal information, including the right to request access, correction or deletion; obtain a copy of certain information; opt out of certain sales, sharing or targeted advertising; withdraw consent where processing is based on consent; or appeal a decision concerning a privacy request.
We may need to verify your identity before completing a request. Authorized agents may submit requests where permitted by law, and we may request proof of authorization. We will not unlawfully discriminate against you for exercising an applicable privacy right.
